The Securities and Exchange Regulator of Cambodia (SERC) is the primary regulatory authority overseeing the securities market in Cambodia. Established in 2007, the SERC has played a crucial role in ensuring the stability and integrity of the country’s securities market. This article explores the history, scope, supervision, investor compensation guarantees, and organizational structure of the SERC.

SERC History

The SERC was established in 2007 under the Law on the Issuance and Trading of Non-Government Securities, which aimed to create a robust regulatory framework for the country’s securities market. Since its inception, the SERC has been committed to fostering a stable, transparent, and efficient securities market that promotes economic growth and investor protection in Cambodia.

SERC Scope and Supervision

The primary objective of the SERC is to maintain the stability and integrity of the securities market in Cambodia. Its wide-ranging responsibilities include:

  1. Licensing and regulating securities market participants: The SERC oversees various securities market participants, such as securities firms, investment advisors, and fund managers, ensuring they adhere to strict regulations and maintain market stability.
  2. Supervising the securities market: The SERC is responsible for regulating and supervising the securities market in Cambodia, ensuring proper disclosure, transparency, and fair trading practices.
  3. Implementing anti-money laundering and counter-terrorism financing measures: The SERC enforces compliance with anti-money laundering (AML) and counter-terrorism financing (CTF) regulations to maintain the integrity of the securities market.
  4. Protecting consumers and investors: The SERC works to safeguard the interests of consumers and investors by enforcing regulations, promoting transparency, and raising awareness of potential risks.

SERC Investor Compensation Guarantees

Currently, there is no specific investor compensation scheme in place in Cambodia. However, the SERC is committed to ensuring a fair and transparent securities market that protects investors’ interests. In the event of disputes or irregularities, the SERC is responsible for investigating and resolving issues to maintain investor confidence and market stability.

Organization Type

The SERC is an independent statutory body that operates under the jurisdiction of the Ministry of Economy and Finance of Cambodia. Its independent status allows the SERC to make impartial decisions in the best interest of the securities market and investors. The SERC is governed by a board of directors, which is responsible for setting the strategic direction and ensuring effective oversight of the organization’s operations. The day-to-day operations of the SERC are managed by its Director General, who is supported by a team of specialists and experts.
